Pool Compliance Works
For South Australian property owners with existing pools, you are not required under the Planning, Development and Infrastructure Act 2016 to have an existing swimming pool or spa pool inspected for compliance. There is also no requirement to have an inspection when selling a property with an existing swimming pool or spa pool.
However there are legal obligations when selling a house with a swimming pool or spa pool, whereby pool fences or pool safety barriers need to be compliant with the standard for the year the pool was built, and a compliance certification from a Licensed Pool Compliance inspector is required for Property Settlement.
Pool compliance is complex legislation.
In South Australia, if your pool is built pre-July 1993 or after June 2010 it will need to comply with the 2012 rules however if your pool was built in-between then it will need to comply with the 1993 rules, and new pool safety barrier regulations are updated every year effecting pools pre 1993 and any current new pools.
And as the owner of a property with a swimming pool or spa pool, you are responsible for safety. Drowning is the biggest cause of accidental death for young children, and horrifically most happen in private backyard swimming pools. You can reduce the risk of accidents in your swimming pool or spa pool by installing appropriate safety barriers and ensuring young children are supervised at all times.
